Race Waiver

1. Who is signing and what is covered

I am at least 18 years old and sign for myself. This agreement concerns my authorized participation as an adult racer in The Mojave Classic, including motorcycle riding, racing, practice, staging and associated pit, course and race-facility activities. It does not give me permission to participate in an activity, enter a restricted area or use land without authorization.

“Released Parties” means MOJAVE MC LLC and its members, managers, officers, employees, event officials and volunteers; the owners and operators of property or facilities made available for the event; and event contractors, sponsors and service providers, but only in connection with their event-related roles. In Dust We Trust and The Mojave Classic are event names operated by MOJAVE MC LLC, not separate organizing entities.

2. Acknowledgment of risks

I understand that motorsports and attendance near motorcycle activity can cause serious injury, permanent disability, paralysis, death and damage to property. Risks include collisions with riders, vehicles, spectators or fixed objects; falls; loss of control; mechanical failure; flying debris; uneven ground, rocks, ruts, holes, washes and changing surfaces; dust and reduced visibility; noise; heat, cold, wind, rain and other weather; fire, fuel and hot equipment; animals; crowded areas; and the acts or omissions of other people.

Camping and use of a remote desert venue involve additional risks, including uneven or unlit walking areas, vehicle movement, exposure and limited communications. Emergency response, extraction and access to medical care may be delayed. Conditions may change, and some hazards may not be obvious, marked, foreseeable or removable. Staff instructions, inspections and safety measures do not eliminate all risks.

3. Voluntary participation and assumption of risk

I choose to attend and undertake only activities I am authorized and prepared to perform. I understand the described risks and voluntarily assume the inherent risks and, to the extent permitted by law, risks arising from ordinary negligence of the Released Parties in the event activities covered by this agreement. I may decline an activity or stop participating if I consider conditions unsafe, and I will notify an event official when reasonably able.

4. Express release of ordinary negligence

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, I RELEASE THE RELEASED PARTIES FROM CLAIMS I MAY HAVE FOR PERSONAL INJURY, DEATH OR PROPERTY DAMAGE ARISING OUT OF MY AUTHORIZED PARTICIPATION IN THE COVERED RACE ACTIVITIES, INCLUDING CLAIMS CAUSED BY A RELEASED PARTY’S ORDINARY NEGLIGENCE.

This includes ordinary negligence relating to event organization, premises and course conditions, supervision, instructions, equipment inspections and event-related acts or omissions, only to the extent a release of those claims is lawful. This provision is intended to apply to claims arising from the covered event, whether the resulting injury becomes apparent immediately or later.

This agreement does not release gross negligence, reckless or intentional misconduct, fraud, willful injury, unlawful conduct to the extent its liability cannot be waived, or any other claim or responsibility that the law does not permit to be released. It does not waive statutory refund rights, workers’ compensation rights, or claims unrelated to the covered activities. It does not release another person’s independent rights where I lack authority to do so.

5. My responsibilities

I will follow event rules, posted signs and lawful directions; remain in areas appropriate to my credentials; use required protective equipment; and avoid riding or participating while impaired. If riding, I am responsible for presenting a motorcycle and equipment suitable for my activity, honestly describing my skill and eligibility, and attending required briefings.

I am responsible for deciding whether my health, ability and preparation are appropriate for an activity and obtaining medical advice when needed. I will not knowingly expose others to an unreasonable risk. These responsibilities do not expand the release beyond its lawful scope or excuse misconduct excluded above.

6. Emergency assistance

If I cannot communicate a decision, I authorize reasonable efforts to obtain emergency medical assistance and transport for me, consistent with applicable law and any known valid medical directive. I understand that professional providers may bill me or my insurer for services and that event admission does not provide personal medical insurance. This authorization does not guarantee treatment or release a medical provider from liability that cannot legally be waived.

7. Adult racers only

I am at least 18 years old and sign only for myself. Minors are not eligible to race under the current Race Rules. Another person’s ticket purchase does not complete my race waiver. This document is not a general-admission or camping signature requirement.

8. Interpretation and acknowledgment

California law governs, subject to applicable federal law. If a provision is unenforceable, it is severed only to the extent permitted by law, without enlarging the remaining release. This agreement contains no mandatory arbitration clause or contractual jury-trial waiver.

I have read this agreement, understand that it includes a release of ordinary-negligence claims, and have had an opportunity to ask questions before signing. I sign voluntarily for the identified event. I understand that a ticket notice is not my signature, and a person purchasing for me cannot sign this release on my behalf.
